Terms of Service

These Terms of Service explain the conditions that apply when you use our website, request an electrical quotation, book an electrician or engage us to perform electrical, maintenance, construction, solar, generator or related work.

Electrical work is performed subject to applicable South African electrical legislation, standards and safety requirements.

Fair Customer Terms

These terms are intended to operate together with, and not unlawfully restrict, rights provided by applicable South African consumer law.

Section 01

Introduction

These Terms of Service govern the use of electricianboksburg24-7.co.za and, where applicable, electrical and related services supplied by Q Tique 28 (Pty) Ltd through Electrician Boksburg 24/7.

The terms apply to website visitors, customers requesting quotations and customers who engage us to provide electrical or related services.

Additional terms appearing on an accepted quotation, estimate, work order, invoice or written agreement may also apply to a particular project.

Consumer rights remain protected Nothing in these Terms is intended to exclude or limit a consumer right that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or other applicable South African legislation.

Section 03

Acceptance of These Terms

By using this website, requesting a quotation, accepting a quotation, requesting that work begin or otherwise engaging us to provide services, you acknowledge that the applicable service terms may form part of the agreement between you and us.

Where a written quotation or work order requires acceptance, the agreement is formed when the quotation or work order is accepted in the manner specified by us.

Acceptance may, where legally permissible, occur electronically, including by email, WhatsApp, electronic form or another recorded communication.

Section 04

Our Services

Depending on availability and the agreed scope of work, services may include:

  • Residential electrical services.
  • Commercial electrical services.
  • Electrical fault finding.
  • Emergency electrical call-outs.
  • Electrical wiring and rewiring.
  • Distribution board work.
  • Power points and electrical outlets.
  • Lighting and lighting controls.
  • Surge protection.
  • Pre-paid meter related electrical work.
  • Electrical maintenance.
  • Electrical installations.
  • Electrical alterations and additions.
  • Certificate of Compliance-related inspection and testing.
  • Solar-related electrical work where agreed.
  • Generator-related electrical work where agreed.
  • Construction electrical work where agreed.
  • Shopfitting electrical work where agreed.

The actual work to be performed will be determined by the accepted quotation, work order, booking or other agreed scope of work.

Section 05

Quotations & Estimates

Where a quotation or estimate is requested, we will endeavour to provide sufficient information about the proposed work and expected charges to allow the customer to make an informed decision.

A quotation may be based on information supplied by the customer, photographs, drawings, descriptions, an inspection or a site visit.

Unless expressly stated to be a fixed quotation, an estimate represents an anticipated cost based on the information reasonably available at the time.

A quotation is valid for the period stated on that quotation. After the stated validity period, pricing and availability may need to be confirmed again.

Quotations may change where:

  • The customer changes the requested scope of work.
  • Additional work is requested.
  • Previously concealed defects are discovered.
  • The information originally supplied was incomplete or inaccurate.
  • Site conditions differ materially from what was reasonably anticipated.
  • Required parts or materials change.
  • Statutory or safety requirements require additional work.
Approval before additional chargeable work Where applicable, we will seek the customer's approval before carrying out material additional chargeable work that falls outside the agreed scope.
Section 06

Authorisation to Perform Work

Where an estimate or quotation is provided, work may begin after the customer has authorised the work in an agreed or legally recognised manner.

Authorisation may include:

  • Signing or electronically accepting a quotation.
  • Email confirmation.
  • WhatsApp confirmation.
  • A recorded written instruction.
  • Payment of an agreed deposit where the quotation states that payment constitutes acceptance.
  • Another form of recorded approval agreed between us and the customer.

Where the Consumer Protection Act requires an estimate or pre-authorisation for repair or maintenance services, we will handle the work subject to those applicable requirements.

Section 07

Call-Out & Inspection Charges

A call-out, inspection, diagnostic or travel charge may apply where disclosed as part of the booking, quotation or service arrangement.

A call-out charge may cover the electrician's travel, attendance, initial inspection and/or time allocated to the service request.

A call-out charge does not automatically include parts, materials, repairs or additional labour unless expressly stated.

Any charge for preparing an estimate, diagnostic work or inspection will be subject to applicable requirements of the Consumer Protection Act where that legislation applies.

Section 08

Emergency & After-Hours Services

Emergency, urgent, weekend, public holiday and after-hours services may carry different rates from standard scheduled work.

Applicable emergency or after-hours charges will be communicated where reasonably possible before attendance or before additional chargeable work proceeds.

The term "24/7" or similar emergency-service wording indicates that customers may contact us for emergency assistance. It does not constitute an unconditional guarantee that an electrician will be immediately available at every location at all times.

Response times can be affected by:

  • Existing emergency jobs.
  • Traffic and road conditions.
  • Distance from the job site.
  • Weather.
  • Safety conditions.
  • Availability of technicians.
  • Availability of parts or materials.
Section 09

Deposits

We may require a deposit before ordering materials, reserving significant labour, scheduling larger projects or commencing particular work.

Where a deposit is required, the amount and payment requirements will be stated on the quotation, invoice or other agreement.

Deposits will be dealt with fairly and in accordance with applicable consumer law.

If a customer cancels work after special-order materials, non-returnable items or other reasonably incurred costs have been committed, those costs may be taken into account where legally permissible.

Section 10

Payment

Payment must be made according to the payment terms stated on the applicable quotation, invoice, work order or agreement.

Unless otherwise agreed in writing, amounts become payable when specified on the invoice or quotation.

Where work is performed in stages, progress payments may be required if stated in the accepted quotation.

The customer should use the invoice, quotation number or customer reference supplied by us when making payment.

If an amount is overdue, we may take reasonable lawful steps to recover payment. Any interest, collection charge or recovery cost will only be applied where permitted by law and the applicable agreement.

Section 11

Parts, Equipment & Materials

Parts and materials will be selected according to the agreed scope, suitability, availability, required specifications and applicable safety requirements.

Product photographs, descriptions or brand references supplied before work begins may be illustrative where an equivalent compliant product is reasonably required due to availability, unless the specific product or brand forms an express part of the agreement.

If a specified product becomes unavailable, we will endeavour to discuss a suitable alternative with the customer before installation where the substitution is material.

Manufacturer warranties remain subject to the manufacturer's applicable terms in addition to rights available under South African law.

Section 12

Variations & Additional Work

Electrical work sometimes reveals faults or requirements that could not reasonably be identified before the work began.

Where additional work outside the agreed scope becomes reasonably necessary, we will endeavour to:

  • Explain the additional work.
  • Explain why the work is required.
  • Advise the customer of additional charges where reasonably possible.
  • Obtain appropriate approval before proceeding with additional chargeable work.

A customer's request to change or expand the scope of a job may result in additional labour, material and scheduling costs.

Section 13

Access to the Property

The customer must provide reasonable and safe access to the property and areas in which the work is to be performed at the agreed appointment time.

This may include reasonable access to:

  • Distribution boards.
  • Electrical outlets.
  • Ceiling spaces.
  • Roof areas where relevant.
  • Electrical equipment.
  • Metering equipment.
  • Garages and outbuildings.
  • Relevant rooms and work areas.

Where access is unavailable, unsafe or materially delayed, the appointment may need to be rescheduled and reasonable charges may apply where legally permissible and previously disclosed.

Section 14

Customer Responsibilities

The customer is responsible for providing information that is materially accurate and complete to the best of their knowledge.

Customers should disclose known matters that may affect the work, including:

  • Previous electrical faults.
  • Known unsafe wiring.
  • Recent renovations.
  • Solar or generator systems.
  • Backup power systems.
  • Previous alterations to electrical installations.
  • Known underground or concealed services.
  • Access restrictions.
  • Hazardous materials or dangerous site conditions.

The customer must not knowingly request an electrician to perform work that is unlawful or contrary to applicable electrical safety requirements.

Section 15

Hidden & Unforeseen Conditions

Electrical faults and installations may contain defects that are not visible until testing, dismantling, opening equipment or accessing concealed parts of the installation.

Examples may include:

  • Burnt or damaged wiring.
  • Illegal electrical alterations.
  • Non-compliant installations.
  • Faulty circuit breakers.
  • Damaged neutral or earth conductors.
  • Hidden junctions.
  • Deteriorated cabling.
  • Overloaded circuits.
  • Water damage.
  • Rodent or pest damage.
  • Previous unprofessional repairs.

Unless those conditions were reasonably identifiable and included in the agreed scope, rectification may constitute additional work requiring customer approval.

Section 16

Electrical Safety

Safety takes priority over convenience or completion speed.

Where an electrician identifies an electrical condition that presents an immediate or material safety concern, the electrician may recommend that affected equipment or circuits remain isolated or switched off until the problem is made safe.

Unsafe installations We will not knowingly perform or approve electrical work that would require us to disregard applicable electrical safety legislation, standards or professional obligations.

If the customer declines recommended corrective work, we may decline to energise, reconnect, certify or continue work on an installation where doing so would be unsafe or unlawful.

Section 17

Electrical Certificate of Compliance

Certificates of Compliance ("CoCs") are governed by applicable South African electrical legislation and may only be issued where the relevant requirements have been satisfied.

Where a CoC forms part of the agreed service, inspection and testing may identify defects that require rectification before the relevant certificate can lawfully be issued.

The cost of rectifying defects is not automatically included in an inspection or CoC quotation unless expressly stated.

Where additional or alteration work requires certification, certification will be handled according to applicable legal requirements and the agreed scope of work.

A CoC cannot simply be "bought" The issuing of a Certificate of Compliance is dependent on the required inspection, testing and compliance of the applicable electrical installation or work.
Section 18

Completion of Work

Work is considered substantially complete when the agreed electrical services have been performed, subject to any outstanding minor items, testing, paperwork or other agreed completion requirements.

The customer should notify us as soon as reasonably possible if they believe that agreed work remains incomplete or that a problem exists with the completed service.

Section 19

Quality of Service & Workmanship

We aim to perform services with the degree of care, skill and quality required by applicable South African law.

Where the Consumer Protection Act applies, nothing in these Terms is intended to reduce the customer's statutory rights relating to the quality and performance of services.

If a customer believes there is a workmanship problem, they should contact us promptly and provide reasonable information so that we can investigate.

Section 20

Warranties & Defects

Any express workmanship or product warranty supplied for a particular job will be subject to the terms stated on the quotation, invoice, warranty document or other written communication and applicable consumer legislation.

A workmanship issue does not normally include a fault caused after completion by matters outside our control, such as:

  • Misuse or abuse.
  • Lightning or power surges.
  • Utility supply problems.
  • Water ingress occurring after completion.
  • Pest or rodent damage.
  • Alterations performed by another person.
  • Failure of unrelated existing wiring or equipment.
  • Normal wear and tear.
  • Failure to follow manufacturer requirements.

This clause does not remove any warranty or remedy that the customer is legally entitled to under applicable legislation.

Section 21

Cancellation & Rescheduling

Customers should notify us as soon as reasonably possible if they need to cancel or reschedule a confirmed appointment or project.

Where cancellation occurs after we have reasonably incurred costs, reserved substantial labour, ordered customer-specific materials or commenced work, reasonable charges may apply subject to the Consumer Protection Act and other applicable law.

We may cancel or reschedule work where reasonably necessary because of:

  • Unsafe working conditions.
  • Severe weather.
  • Unavailable materials.
  • Staff illness or emergency.
  • Vehicle or equipment failure.
  • Customer access problems.
  • Unforeseen technical complications.
  • Events beyond our reasonable control.
Section 22

Scheduling & Delays

Appointment times and completion dates are scheduled in good faith based on the information available at the time.

Electrical work can involve unforeseen technical conditions, emergency call-outs and dependencies on suppliers or third parties.

We will endeavour to communicate material delays where reasonably possible.

An estimated arrival or completion time is not a guarantee unless expressly agreed as such in writing.

Section 23

Property, Walls & Concealed Services

Electrical installation work can reasonably require drilling, chasing, cutting, opening ceilings, lifting access panels or otherwise accessing concealed wiring.

Where such work forms part of the agreed scope, reasonable access work may be required to complete the electrical service.

The customer should disclose known concealed:

  • Water pipes.
  • Gas lines.
  • Data cables.
  • Security wiring.
  • Underfloor heating.
  • Other concealed services.

Painting, plastering, tiling, carpentry or other decorative reinstatement is not included unless expressly stated in the agreed scope of work.

Section 24

Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be prohibited by the Consumer Protection Act or other applicable South African law.

Subject to those statutory rights, we are not responsible for losses caused solely by events or conditions outside our reasonable control, including faults in unrelated existing electrical installations, utility supply failures, customer misuse or unauthorised work performed by third parties.

Customers must take reasonable steps to limit or prevent further loss after becoming aware of an electrical fault or unsafe condition.

Electrical emergencies If there is an immediate danger of electric shock, fire, burning wiring or another serious electrical hazard, keep people away from the danger and disconnect the supply only if it is safe to do so. Contact the appropriate emergency services where necessary.
Section 25

Use of This Website

The website is provided to supply information about our business and services and to allow customers to contact us or request assistance.

You may not knowingly use this website to:

  • Commit an unlawful act.
  • Attempt unauthorised access to the website or server.
  • Distribute malicious software.
  • Interfere with website security.
  • Submit fraudulent enquiries.
  • Impersonate another person.
  • Harvest personal information unlawfully.
  • Copy protected content for unlawful commercial use.

Intellectual Property

Unless otherwise stated, website content including text, graphics, layouts, logos, photographs and other original materials is owned by or licensed to us and is protected by applicable intellectual property law.

Electronic Communications

Where legally permissible, communications and agreements may be concluded or recorded electronically.

This may include communications through:

  • WhatsApp.
  • Website forms.
  • Electronic quotations.
  • Electronic invoices.
  • Other agreed digital communication methods.

Customers are responsible for ensuring that contact information supplied to us is reasonably accurate.

Section 30

Complaints & Disputes

If you are dissatisfied with our service, please contact us first so that we have a reasonable opportunity to investigate and address the matter.

Please provide:

  • Your name.
  • Your contact details.
  • The relevant address.
  • Quotation or invoice number where available.
  • A clear description of the problem.
  • Supporting photographs where relevant.

Nothing in this section prevents a consumer from exercising any right or approaching an authority, commission, ombud, tribunal or court where permitted by South African law.

Section 31

Governing Law

These Terms and the use of this website are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with under applicable South African law and through a court, tribunal, commission, ombud or other dispute-resolution body having lawful jurisdiction where applicable.

Section 32

General Provisions

Entire Agreement

These Terms should be read together with any accepted quotation, work order, invoice, written agreement and Privacy Policy that applies to the relevant transaction.

Conflict

If a specific written quotation or contract contains a provision that differs from these general Terms, the specifically agreed provision will ordinarily apply to that transaction, subject to applicable law.

Severability

If a provision of these Terms is found to be unlawful or unenforceable, that provision may be treated as severable to the extent permitted by law without automatically invalidating the remaining Terms.

No Waiver

A failure or delay in enforcing a contractual right does not necessarily constitute a permanent waiver of that right.

Changes to These Terms

We may update these website Terms from time to time to reflect changes to our services, business practices or applicable law.

Changes will be published on this page together with an updated revision date.

Terms applicable to work already accepted will remain subject to the agreement governing that transaction and applicable law.
